1. Acceptance of these terms
These Terms of Service ("Terms") are an agreement between you and Viral Lab ("Viral Lab," "we," "us," or "our") covering your use of virallab.studio and any related services (the "Platform").
By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
2. What Viral Lab is
Viral Lab connects creators with brand campaigns and pays for measured performance. Creators join a campaign, post content to their own social accounts, and earn a set rate for every 1,000 views that content generates.
We provide the technology that matches creators to campaigns, measures performance, and processes payment. We are not an employer, a staffing agency, or a party to any separate agreement you may reach with a brand. Creators act as independent contractors and control their own methods, schedule, and equipment, subject to the requirements of each campaign brief.
3. Eligibility and accounts
Age
You must be at least 18 years old to use the Platform. Our payment provider requires account holders to be adults, so we cannot pay creators under 18 under any circumstances.
Your account
You sign in with Google or with an email address and password. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Tell us promptly if you believe someone else has accessed it.
One person may hold one account. Creating additional accounts to rejoin a campaign, evade a decision, or claim the same content twice is grounds for termination.
Your social accounts
You must register the social account you will post from, and it must be an account you personally own and control. It must be public so that view counts can be measured. Only content published after you register a handle is eligible to earn.
Identity and payment verification
Before you can be paid you must complete identity verification through our payment provider, including any government-issued identification and tax documentation they require.
Where we operate
Availability may be limited by country, and individual campaigns may be restricted to specific regions. You are responsible for complying with the laws and tax rules that apply where you live.
4. Campaigns and deliverables
Each campaign has its own brief, rate per 1,000 views, and number of posts you are expected to deliver. You accept those terms when you join the campaign and sign its agreement.
Applying to a campaign does not guarantee acceptance. We may decline any application, and we may close or change a campaign at any time. If a campaign closes, content you already published and had approved remains payable.
Content must stay publicly available. If you delete a post, make your account private, or the platform removes your content, it stops accruing views and we may exclude it from your earnings.
5. Content standards
You are responsible for everything you post. Content submitted to a campaign must not:
- Promote illegal activity, or contain hate speech, harassment, or threats
- Infringe anyone's copyright, trademark, or other rights, including unlicensed music, footage, or images
- Be misleading or deceptive about the product being promoted
- Target children, or feature minors without the consent of their parent or guardian
- Violate the community guidelines of the platform you publish it on
We do not review content before you publish it, but we review it before it earns, and we may reject or remove anything that breaches these standards.
6. Advertising disclosure
Sponsored content must be disclosed. Where you are paid to promote a product, US Federal Trade Commission guidance requires the relationship to be clear to anyone who sees the post, and equivalent rules apply in most other countries.
- Use plain wording such as #ad, #sponsored, or paid partnership
- Place the disclosure where it is visible immediately, not buried at the end of a caption or behind a "more" link
- In video, say it as well as showing it
- Use the platform's own paid-partnership label where one exists
Content that lacks a clear disclosure may be rejected and will not earn.
7. Authentic engagement
Because we pay per view, the integrity of those views is fundamental. You may not buy views, likes, or followers; use bots, automation, or click farms; or otherwise inflate metrics by artificial means.
If we determine that views were manipulated, we may withhold or reverse the affected earnings, remove the content, and terminate your account. Where we have already paid for views we later find to be fraudulent, you agree to repay those amounts.
8. AI-generated content
AI-generated content is not permitted unless the campaign brief expressly allows it. This covers fully synthetic video, AI voice clones, and deepfakes. Submitting such content to a campaign that does not allow it may result in rejection of the post, forfeiture of its earnings, and removal from the campaign.
Where a campaign does allow AI-generated content, you must label it clearly in the post.
Ordinary editing tools like captions, filters, background music and colour grading are not treated as AI-generated content.
9. How earnings work
Earnings are calculated as:
views ÷ 1,000 × the campaign's rate per 1,000 views
How views are counted
We measure view counts from the public data on the platform where you posted, refreshed periodically. Because we always use the most recent figure, a post that keeps being watched keeps earning. We do not count views on content that is private, deleted, or posted from an account you have not registered with us.
Review and approval
Posts are reviewed before they count toward your balance. A post can be pending, approved, or rejected. Your dashboard shows what pending posts would be worth, but only approved posts are payable. We may reject a post that does not follow the campaign brief, lacks a required disclosure, or breaches these Terms.
No guarantee
Nothing here guarantees a level of earnings. Any figures shown in marketing material are examples, not promises. What you earn depends on how your content performs.
10. Payouts and taxes
Getting paid
Payouts are handled by Stripe. You must connect a payout account and complete Stripe's verification before any money can be sent. We do not see or store your full bank details.
When you can request a payout
You can request a payout once you have delivered the number of approved posts your campaign requires, which is 30 by default. There is no waiting period beyond that; the requirement is based on delivered work, not on time. A small minimum balance also applies because payment processors cannot transfer trivial amounts.
Requests are reviewed by our team before payment is sent. We may hold a payout while we investigate suspected fraud, a dispute over content, or a request from our payment provider.
Taxes
You are an independent contractor and are responsible for your own taxes. We do not withhold tax. Where required, we or our payment provider will issue the appropriate tax forms, such as a 1099-NEC for US creators who pass the reporting threshold.
11. Intellectual property
Your content
You keep ownership of the content you create. By submitting it to a campaign you grant us and the campaign's brand a worldwide, royalty-free licence to use, reproduce, and display that content in connection with the campaign and to promote the Platform. Individual campaign agreements may grant the brand broader rights, and those will be set out in the agreement you sign.
Our content
The Platform itself, including its software, design, branding, and any templates or training material we provide, belongs to Viral Lab. You may not copy, resell, or redistribute it.
Third-party material
You are responsible for holding the rights to anything you include in your content, including music, stock footage, and other people's likenesses.
12. Prohibited activities
- Creating multiple accounts, or sharing, selling, or transferring your account
- Claiming content posted by someone else, or from an account you do not control
- Submitting the same content to more than one campaign without permission
- Arranging payment directly with a brand for work sourced through Viral Lab in order to avoid the Platform
- Scraping, reverse engineering, or interfering with the Platform, or attempting to bypass its security
- Misrepresenting your identity, location, or audience
13. Suspension and termination
You can stop using the Platform at any time and ask us to close your account.
We may suspend or terminate an account that breaches these Terms, engages in fraud, or creates legal risk. Where the reason is minor and fixable we will normally warn you first; where it involves fraud we may act immediately.
If your account is closed, earnings already approved and legitimately generated will still be paid, less any amounts owed to us. Earnings tied to fraudulent activity are forfeited. Provisions that by their nature should survive termination, including intellectual property, disclaimers, liability, and dispute resolution, continue to apply.
14. Disclaimers
The Platform is provided "as is" and "as available." To the fullest extent permitted by law we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We aim to keep the Platform running continuously but cannot guarantee uninterrupted access. We depend on third parties such as social platforms, analytics providers, and payment processors, and are not responsible for their outages, policy changes, or decisions about your accounts on their services.
15. Limitation of liability
To the fullest extent permitted by law, Viral Lab is not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or lost opportunities.
Our total liability for any claim will not exceed the greater of (a) US$100 and (b) the total amount we paid you in the six months before the event giving rise to the claim.
16. Dispute resolution
Talk to us first
Most problems can be sorted out quickly. Before starting formal proceedings, contact us and give us 30 days to resolve the issue.
Arbitration
If we cannot resolve it, disputes will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Either of us may still seek an injunction to protect intellectual property or stop unauthorised use of the Platform.
Individual claims only
Claims may only be brought individually, not as part of a class or representative action.
Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules.
17. Changes to these Terms
We may update these Terms. When the changes are material we will give notice by email or through the Platform at least 30 days before they take effect. Continuing to use the Platform after that means you accept the updated Terms.
